Bob Zimmer- Summarizes status of the application. Reviews the variances the applicant received from the ZBA for area variances for rear yard of 30’ where 50’ is required, and number of stories for 3 where 2.5 is allowed. Points to the fact that there have been new plans submitted with slight changes, and asks that the representative go over the changes.

 

Michael from Shalat Architects- The changes are in response to the comments received from the Board the first time we were before the Planning Board. The biggest change is the one to the docks both the arrangement of and the count of slips. It did not comply with coast guard regulations so we pushed it back and in single file. One of the Village Engineer’s comments was that the docks and the bulkhead would need DEC approval so we are preparing to submit this to them next week.

 

Bob Zimmer- Okay good. And are these changes to the parking spaces?

 

Michael- Yes, our soil testing came back which means our septic system won’t have the capacity that we had been planning for, and we are not able to have as many seats in the restaurant as we had previously thought we could have. So, we dialed back the number of seating in the restaurant which in turn dialed back the number of parking spaces required.

 

Bob Zimmer- What is the status of the septic system review at the County level?

 

Keith Woodruff (Applicants’ Engineer)- So it is still an ongoing applicant before the Health Dept.

 

Bob Zimmer- It is taking so long. What are they asking for now?

 

Keith Woodruff- Because it is not a traditional residential septic system that is before them so it is not something that they are used to seeing. There are atypical aspects to the design.

 

Bob Zimmer- You changed the interior a little too, changed to wine storage to a court yard.

 

Michael- It was always a court yard but we removed the circular wine display and bar. We moved that to the interior. Because when we were losing seats, those were the least valuable seats.

 

Bob Zimmer- How does the court yard work as far as storm water runoff.

 

Michael- It has its own drainage.

 

Bob Zimmer- Directed where?

 

Michael- It will have to be pumped out because of its lower elevation. Mentions that this is part of the Village Engineers comments for this meeting that they need a Stormwater management plan clearly outlined.

 

Bob Zimmer- Please make sure that the court yard is a part of that. I want to wait to hear directly from our Engineer when he arrives, so let’s go to Board members comments.

 

John Tracy- Asked about docks and the slips being single file only?

 

Overlapping conversation discussing docks- take away there is now a 20’ clearance on either side. Suggested by some Board members they may want to redesign the docks as well in order to have more available slips for customers.

 

Alyse Terhune- The other issue is that there is a chapter in the Village Code regarding environmental review and this qualifies as a Type I action so the assumption here is that we need to recirculate the notice of lead agency. The code also has some conflicting requirements so I am waiting to hear back from the Village Attorney.

 

Jamison (Village Engineer)- You should show the utilities existing and proposed. You should also have a Fire plan so that we can consult the FD and ask whether they have comment. Add no parking anytime signs where required. I will recirculate the lead agency.

 

Bob Zimmer- Next month it will be a Public Hearing. Can I get a vote.

 

Board all votes “Aye” on having a Public hearing for this applicant at next month’s meeting.

 

Applicant #4 6 Van Orden Ln:

 

Bob Zimmer- Reads application for second story addition into the record. Asks applicant to explain the plans and the intentions for the project.

 

Eric Osborn (Architect for applicant)- We intend to remove the roof and add a second floor on the existing building plus add a deck in the rear. The existing lot coverage is existing non-conforming which is why we need to go to the ZBA. The rear deck will also require a variance.

 

Bob Zimmer- Are you building on the same foundation, replacing or building new foundation?

 

Eric Osborn- Keeping the existing foundation with the addition on posts, steel post with concrete piers.

 

Jack Sirios- Points out that there is an area on the drawings that show additional new foundation not posts.

 

Eric Osborn- replies that it is not correct.

 

Jack Sirios- Says that should be corrected and specified. Is there a way to get out of the basement going forward?

 

Eric Osborn- Yes there is a door.

 

Overlapping conversation regarding what is and is not expanding the existing the non-conformity, and exactly what variances will be needed.

 

Charles Pekarek- Asks about there being no additional bedrooms added.

 

Alyse Terhune- Consider whether or not you need a story variance (depending on whether or not the basement is considered a story) and a total side yard variance, one side yard, rear yard, and lot coverage.

 

Overlapping conversation about the additional square footage and bedroom count. And also, whether or not the basement is a true “story”.

 

Jack Sirios- Makes comments on the drawings and asks for changes so that the drawings are easier to read next meeting.

 

Bob Zimmer- The utilities should be called out on the drawings as well as the septic system and the waterline should be marked.

 

Overlapping conversation about the septic system being upgraded and if so, perhaps the applicant would want to consider upping the bedroom count.

 

Ed Mateo- Clarifies the Village code regarding stories.
